Terms of Service

1. Agreement to these Terms

By creating a Listwell account, checking the agreement box, or using the authenticated portions of the service, you agree to these Terms of Service. If you do not agree, do not create an account or continue using the authenticated service.

The Privacy Policy describes how Listwell handles personal information. Acknowledging that policy does not create consent for optional marketing or other processing where separate consent is required.

2. Account eligibility

You must be at least 13 years old to create or use a Listwell account. If you are under the age of majority where you live, you may use Listwell only with permission from a parent or legal guardian, who should review these Terms with you.

Listwell does not permit accounts for children under 13. A parent or guardian may use their own account to organize lists or events for a family, but should provide a child's personal information only when authorized and reasonably necessary.

3. What Listwell provides

Listwell helps people save product ideas, organize items into lists, share selected information, create events, and coordinate item claims. Listwell does not sell the listed products, process purchases from third-party stores, guarantee that an item remains available, or guarantee that another participant will purchase or bring a claimed item.

4. Accounts and security

• Provide accurate account information and keep it current.
• Keep your credentials secure and notify Listwell if you believe your account has been compromised.
• You are responsible for activity performed through your account unless prohibited by applicable law.
• Third-party sign-in services may also apply their own terms and privacy policies.

5. Your content and sharing choices

You retain ownership of the titles, descriptions, images, links, and other content you provide. You give Listwell a non-exclusive, worldwide, royalty-free license to host, copy, process, display, and transmit that content only as needed to operate, secure, improve, and support the service and the sharing choices you make.

Event participants and people with an active share or invitation link may see content associated with that event or link. You are responsible for choosing what to share and for having the right to submit information about another person.

6. Acceptable use

• Do not use Listwell unlawfully, fraudulently, deceptively, or to harm another person.
• Do not upload content that infringes intellectual property, privacy, publicity, or other rights.
• Do not harass users, distribute spam, introduce malicious code, scrape private information, or bypass access controls.
• Do not post threatening, sexually exploitative, hateful, or otherwise objectionable content. Use Listwell's in-app controls to report content or block another user when needed.
• Do not interfere with the operation or security of Listwell or attempt unauthorized access.

7. Third-party products and links

Listwell may display links, product information, images, or recommendations originating from third-party stores and services. Those parties control their products, prices, availability, ordering, returns, and privacy practices. Review their terms before completing a transaction.

Some product links or recommendations in Listwell are affiliate links. If you follow one and complete a qualifying purchase, Listwell may receive a commission from the merchant or affiliate network. This generally does not increase the price you pay. A link submitted by a user is not necessarily an affiliate link.

8. Suspension and termination

You may stop using Listwell and delete your account through the available account controls. Listwell may restrict or terminate access when reasonably necessary to protect users or the service, comply with law, investigate misuse, or enforce these Terms.

9. Service availability and disclaimers

Listwell is provided on an as-available basis. To the extent permitted by law, Listwell does not promise uninterrupted availability or the accuracy, availability, safety, or quality of third-party products and content. Nothing in these Terms limits rights that cannot legally be limited.

10. Changes

Listwell may update these Terms as the service or applicable requirements change. Material changes will be identified with a new version and effective date. When renewed acceptance is required, you will be asked to accept the updated Terms before continuing to use authenticated features.
